This law firm is acting as a debt collector attempting to collect a debt. any information obtained will be used for that purpose.
Under and by virtue of the Power of Sale contained in a Security Deed given by Nicole B. Austin to Mortgage Electronic Registration Systems, Inc., dated November 27, 2006, recorded in Deed Book 249, Page 436, Wilcox County, Georgia Records, as last transferred to SunTrust Mortgage, Inc. by assignment recorded in Deed Book 271, Page 365, Wilcox County, Georgia Records,conveying the after-described property to secure a Note in the original principal amount of ONE HUNDRED NINE THOUSAND FIVE HUNDRED AND 0/100 DOLLARS ($109,500.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Wilcox County, Georgia within the legal hours of sale on the first Tuesday in December, 2009, the following described property: SEE EXHIBIT A ATTACHED HERETO AND MADE A PART HEREOF
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorneys fees (notice of intent to collect attorneys fees having been given).
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.

NOTICE OF SALE
Georgia, Wilcox County.
Under and by virtue of the power of sale contained in that certain security deed from Stacy C. Bloodsworth. to Colony Bank, formally known as Colony Bank Wilcox dated August 22, 2006, and recorded in Deed Book 247, at Pages 246-250, in the office of the Clerk of the Superior Court of Wilcox County, Georgia, and further by virtue of the default in the payment of the indebtedness secured by said deed to secure debt and for the purpose of paying the indebtedness secured by said deed to secure debt together with the costs of sale and together with attorneys fees as provided by said security deed, proper notice of the enforcement of the same and of intention to collect attorneys fees in accordance with the terms of the note secured by said deed having been given to the said Stacy C. NOTICE OF FORECLOSURE
Georgia, Wilcox County
On January 30, 2009, Angelyn V. Rhodes executed a note for
$34,230.93, payable to Wilcox County State Bank, which note with interest thereon, was payable in 23 installments of $352.06 ea., beginning on March 1, 2009, with a final payment of $26133.55 due on February 1, 2011, each payment being applied to the interest then due and the balance to the reduction of the principal amount, interest being computed on the unpaid principal. Time was made the essence of the contract, and the note contained a provision for the payment of 15 percent of the principal and interest as attorneys fees, if collected by law or through an attorney at law. In order to secure the payment of said note, Angelyn V. Rhodes executed and delivered to Wilcox County State Bank, one deed to secure a debt, conveying the following described land: Lot Number 1 in Block Number 10 of the Fitzgerald Subdivision according to survey and plat made by S.Y.A. Ball on March 21, 1966, and recorded in Plat Book No. 3, page 156 in the Office of the Clerk of Superior Court in Abbeville, Wilcox County, Georgia. Said lot being a part of lot of land Number 281, the 8th District of Wilcox County, Georgia. Said lot fronting 125 feet on Second Avenue, East and bounded on the East by Lot No., South by lands of Delma Mashburn, West by Stewart Street, and North by Second Avenue. For a more thorough description reference is made to above mentioned plat. Said Deed is recorded in Deed Book 162 , pp. 354-355, Wilcox County, Records. Because the said Angelyn V. Rhodes defaulted in making payment of the monthly installments as they matured, the Wilcox County State Bank, pursuant to the provisions of said note and the deed aforesaid securing the same has exercised its option and declared the entire balance due and collectible. Notice fixing the liability for attorneys fees has been given according to law. There is a balance due of $29,658.58, as of 10/20/2009, principal, besides interest and attorneys fees thereon. The property will be sold as the property of Angelyn V. Rhodes, who, to the best of the undersigneds knowledge and belief, is the party in possession.
The said deed contains a power of sale, authorizing the grantee, as attorney in fact for grantor therein to sell the property conveyed thereby in order to satisfy said note, as well as subseque nt advances, after advertising the same once a week for four weeks in the official gazette of said County, and in accordance with said power of sale and by virtue thereof the Wilcox County State Bank will sell the property above described at public outcry to the highest and best bidder for cash, on the first Tuesday in December, 2009, being December 1, 2009, at the place of public sales before the courthouse door in Wilcox County, Georgia, and within the legal hours of sale.
The proceeds of the sale will be used as follows: (a) To pay the expenses of said sale; (b) To pay the sums secured by said deed; (c) The balance to Angelyn V. Rhodes.
